Rental Conditions and Privacy Agreement

Vacation Rental Agreement

This is a vacation rental agreement under the North Carolina Vacation Rental Act. Your signature on this agreement, payment of money, or taking possession of the property after receipt of the agreement, is evidence of your acceptance of the agreement and your intent to use this property for a vacation rental.

Check-In and Check-Out

  • Check-in time is 3:00 PM and check-out time is 10:00 AM.
  • You will receive a door code to access your dome.
  • Cleaning services are included in your rental agreement.
  • Upon departure, please tidy up the property, return furniture to its original positions, put trash in the large trash can, and put out any outdoor fires.

Payments/Charges and Responsible Party

  • A 50% deposit is required to confirm your reservation. The balance is due according to the cancellation policy.
  • All reservations are subject to applicable taxes, a cleaning fee, and a security deposit.
  • Payments must be made using a credit card or account in the guest’s name.
  • The person whose credit card is charged is responsible for all guests in their party and their damages.

Pets

  • We approve dogs with a non-refundable pet fee of $30 for up to two dogs at Geodome or A-Frame ($50 for Modern Cabin). All pets should be crated if left unattended and on a leash at the Geodome or A-Frame. You are responsible for cleaning up after your pets.

Security Deposit

  • A $50 security deposit is required for the Geodome or A-Frame reservations.
  • A $200 security deposit is required for the Modern Cabin.
  • The security deposit covers excessive cleaning, damages, and missing camping items. Security deposits will be reviewed and returned within seven (7) days of departure.

Cancellation Policy

  • Guests may cancel within 24 hours of booking and receive a full refund, assuming your arrival date is NOT within the next 72 hours.
  • 75% of paid prepayments are refundable when cancelled 21 days before arrival
  • 50% of paid prepayments are refundable when cancelled 15-20 days before arrival.
  • 0% of paid prepayments are refundable 14 days or less before arrival

Weather and Road Conditions

  • Weather is unpredictable and there are no refunds due to weather or road conditions.

Expedited Eviction

  • Guests may be evicted for holding over in possession after their tenancy has expired, committing a material breach of the agreement, failing to pay rent, or obtaining possession of the premises by fraud or misrepresentation.

Rental Capacity and Number of Cars and Events

  • Domes allow a maximum of four guests. The A-Frame allows a maximum of two guests. Any more guests on property than the maximum is considered an unauthorized event and is grounds for eviction.
  • Events and gatherings must be approved by Fall Creek Retreats LLC in advance.
  • There is a maximum of two cars per glamping site. No driving on property/trails. Park in the parking lot and walk in to your dome or A-Frame. Carry carts are available for your use.

Amenities

  • Our Glamping sites do not have water plumbing and use batteries and/or generator for electricity.
  • Heat is supplie via generator or vented propane. Currently no wifi. Propane grills for cooking.
  • Fall Creek Retreats is not responsible for weather conditions, and there will be no refunds due to the lack of these amenities.

Substitution and Entry

  • Fall Creek Retreats reserves the right to substitute accommodations as circumstances may require.
  • Fall Creek Retreats reserves the right to enter the property during reasonable hours for repair or care of the property.

Liability

  • Fall Creek Retreats, LLC rents glamping tents and structures on privately owned land. Neither Fall Creek Retreats LLC nor the owner is responsible or liable for any bodily injury, loss of personal property, or damage of any nature from any cause to the renter, which includes the paying guests’ guests. Fall Creek Retreats is not responsible for weather, road conditions, creek height, insects or rodents, acts of God, criminal activities, or any activity or event beyond its control.

Indemnification and Hold Harmless

  • Guest agrees to indemnify and hold harmless Fall Creek Retreats LLC and the property owner from and against any liability for personal injury or property damage sustained by a guest or guests’ guests as a result of any cause, unless caused by the negligent or willful act of Fall Creek Retreats or the owners.

No Smoking

  • All properties are non-smoking. If any sign of smoking is found inside a structure, the guest will be responsible for remediation and its cost in full.

Acknowledgment

I agree to abide by this Vacation Rental Agreement, all of its rules and policies as they pertain to the property I am renting. I will approve my pet and pay my pet fee in advance. I will make good decisions while on property. I authorize the use of my credit card for any damages, excessive cleaning, or missing items during my stay.
